Customer Service Correspondence
If you send us correspondence, including e-mails and faxes, we retain such information. We will also retain customer service correspondence and other correspondence from WacoCremation.com / WacoFuneral.com to you. We retain these records in order to measure and improve our customer service, and to investigate potential fraud and violations of our User Agreement. We may, over time, delete these records if permitted by law.
Internal Uses
We collect, store and process your loved one’s personal information. We use the information we collect about your loved one in order 1) to complete a Death Certificate and other required legal documents required for cremation 2) to provide customer service, 3) to complete the cremation arrangements in accordance to your wishes, and 4) to improve our products and services.
We give access to individually identifiable information about our families only to those employees and agents who require it to fulfill the cremation wishes of the family. We provide protection against unauthorized disclosure of information you share with us. We limit associate access to our customer files only to those on a need-to-know basis. We also educate these associates about their responsibility to protect your privacy, and we give them clear guidelines for adhering to our policies and standards.
Vital Statistic Information
When you use “WacoCremation.com” to complete Online Cremation and Funeral Service Arrangements, we will gather information about your loved one to complete a Death Certificate and other legal documents needed to fulfill your wishes for cremation.
WARNING:
The penalty for knowingly making a false statement on a Death Certificate can be 2-10 years in prison and a fine up to $10,000.00.

Unless noted, all information is required to fully complete these documents in accordance with the
Texas Department of Heath and Human Services and the Texas Funeral Service Commission.
Authorizing Legal Documents for Cremation
By digitally signing the cremation authorization form(s), you confirm the identity of the deceased person and the time and date of death; you have identified yourself as the authorizing agent and state the relationship between the authorizing agent and the deceased person; you certify that you are the authorizing agent that has the right to authorize the cremation of the deceased person and is not aware of any person with a superior or equal priority right; and you are 18 years of age or older. If another person has an equal priority right to authorize cremation, you state as the authorizing agent that you: have made all reasonable efforts but failed to contact that person and believes the person would not object to the cremation; you agree to indemnify and hold harmless the funeral establishment and the crematory establishment for any liability arising from performing the cremation without the person’s authorization. We take your word that you are the legal next of kin. We have no way of confirming otherwise and are doing so in good faith. 711.002. Disposition of Remains; Duty to Inter
Unless a decedent has left directions in writing for the disposition of the decedent’s remains as provided in Subsection (g), the following persons, in the priory listed, have the right to control the disposition, including cremation, of the decedent’s remains, shall inter the remains, and are liable for the reasonable cost of interment:
(1) the person designated in a written instrument signed by the decedent.
(2) the decedent’s surviving spouse;
(3) any one of the decedent’s surviving adult children;
(4) either one of the decedent’s surviving parents;
(5) any one of the decedent’s surviving adult siblings; or
(6) any adult person in the next degree of kinship in the order named by law to inherit the estate of the decedent.
